Terms of participation
1. Scope of Application
These terms and conditions of participation apply to all sweepstakes conducted by DRYLL GmbH, Alte Jakobstraße 85-86, 10179 Berlin (hereinafter referred to as "Organizer"). By participating, each participant accepts these terms and conditions.
This sweepstakes is in no way associated with Instagram. It is not sponsored, endorsed, or organized by Instagram and does not establish any legal claims against Instagram. All information provided within the framework of this sweepstakes is exclusively provided by the Organizer.
2. Participation
2.1 Any natural person aged 18 or older is eligible to participate. Participants who are at least sixteen years old but not yet of legal age may only participate with the consent of their legal guardians.
2.2 Minors under 16 years of age, as well as persons without legal capacity, are excluded from participation.
2.3 The Organizer reserves the right to exclude individuals from participation who violate these terms and conditions or attempt to gain an advantage through unauthorized influence or manipulation of the sweepstakes. In such cases, the Organizer may also subsequently exclude participants from the sweepstakes, revoke prizes, and reclaim them.
2.4 Participation is only possible within the period specified in the sweepstakes description. Each participant may only participate once in an identical sweepstakes.
2.5 Employees of the Organizer, as well as employees of companies involved in the sweepstakes and their immediate family members, are excluded from participation.
3. Execution of the Sweepstakes
3.1 A prerequisite for participation is following the Organizer's Instagram channel. If any further conditions are required, these will be specified in the participation details of the sweepstakes. The sweepstakes will be conducted within the specified period. All participants who meet the stated conditions by the time of the drawing will be considered. After the participation deadline, the winner will be determined by random selection.
3.2 A change or cash payment of the prize is excluded. The prize is not transferable.
4. Prize Redemption
4.1 The winner will be notified by Instagram Direct Message (@dryll) or other electronic means by the Organizer. The notified participant must inform the Organizer within one month of notification whether they accept the prize. Otherwise, the prize will be forfeited, and another participant will be notified.
4.2 Incorrect contact information is the responsibility of the participant.
4.3 Should the delivery of a material prize fail, the Organizer will endeavor to have the damage settled by the shipping service provider. However, there is no claim to the prize in this case.
5. Liability for Defects
The Organizer is only liable for damages resulting from material or legal defects in the prize in cases of malice, intent, or gross negligence. Further liability claims are excluded.
6. Early Termination, Adjustment, or Modification of the Sweepstakes
The Organizer reserves the right to terminate or modify the sweepstakes at any time without prior notice if proper execution is not possible for technical or legal reasons.
7. Applicable Law
All legal relationships are governed by the law of the Federal Republic of Germany. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
8. Data Protection
Responsible for data processing in connection with the sweepstakes is:

The named controller is jointly responsible for the data processing on the Instagram fan page where the sweepstakes is held, together with Instagram (platform operator is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) within the meaning of Art. 26 GDPR.
8.1. Processing of Personal Data
We process your personal data for the proper conduct and execution of the sweepstakes and, in particular, for the delivery of the prize.
For the execution of the sweepstakes, the profile name, and, if available, the first and last name of the respective participant are collected and stored. For the delivery of the prize, we additionally collect the first and last name and address of the winner(s) and pass this data on to a shipping company commissioned by us. No further transfer of your data to third parties will take place.
The legal basis for these processing operations of your personal data is Art. 6 para. 1 lit. b GDPR (performance of pre-contractual measures and fulfillment of a contract).
8.2. Storage Period
After the end of the sweepstakes, your personal data processed in connection with the sweepstakes will be deleted at the latest three months after the end of the sweepstakes, unless there is effective consent for further processing (e.g., regarding newsletter distribution) and/or we have no legitimate interest in continued storage.
8.3. Data Subject Rights
The applicable data protection law grants you the data subject rights listed below:
Right to information pursuant to Art. 15 GDPR:
You have a right to obtain information about your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected by us from you, the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved and the significance and envisaged consequences of such processing for you, as well as your right to be informed about which safeguards pursuant to Art. 46 GDPR exist when your data is transferred to third countries;
Right to rectification pursuant to Art. 16 GDPR:
You have a right to immediate rectification of inaccurate data concerning you and/or completion of your incomplete data stored by us;
Right to erasure pursuant to Art. 17 GDPR:
You have the right to request the erasure of your personal data if the conditions of Art. 17 para. 1 GDPR are met. However, this right does not exist, in particular, if the processing is necessary for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;
Right to restriction of processing pursuant to Art. 18 GDPR:
You have the right to request the restriction of the processing of your personal data for as long as the accuracy of your data contested by you is being verified, if you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data, if you need your data for the establishment, exercise, or defense of legal claims after we no longer need this data for the purpose for which it was collected, or if you have objected to processing for reasons relating to your particular situation, pending verification whether our legitimate grounds override yours;
Right to notification pursuant to Art. 19 GDPR:
If you have asserted the right to rectification, erasure, or restriction of processing against the controller, the controller is obliged to communicate this rectification or erasure of data or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort. You have the right to be informed about these recipients.
Right to data portability pursuant to Art. 20 GDPR:
You have the right to receive your personal data, which you have provided to us, in a structured, commonly used, and machine-readable format or to request transmission to another controller, where technically feasible;
Right to withdraw consent given pursuant to Art. 7 para. 3 GDPR:
You have the right to withdraw consent to the processing of data at any time with effect for the future. In the event of withdrawal, we will immediately delete the data concerned, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal;
Right to lodge a complaint pursuant to Art. 77 GDPR:
If you believe that the processing of personal data concerning you infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the place of the alleged infringement, without prejudice to any other administrative or judicial remedy.
